Himachal Pradesh Legal Heir Certificate

The legal heir is any individual who succeeds a deceased person by either will or law. A Legal heir certificate is an authorized document that attests to the relationship between the legal heir and the deceased. In this article, we detail the procedure and other aspects of obtaining a Himachal Pradesh Legal Heir Certificate.

Legal Heirs of the Deceased

Previously, a legal heir comprised only the direct descendant of the deceased, excluding the spouse, adopted children, parents, and collateral relatives. Presently, besides the descendant, any collateral relative can be a legal heir if specifically mentioned in the legal documents. Under Indian laws, the individuals listed below are considered legal heirs:

  • Spouse of the deceased
  • Son of the deceased
  • Daughter of the deceased
  • Father of the deceased
  • Mother of the deceased

Functions of the Legal Heir Certificate

The legal heir certificate aids in accessing pension, gratuity, insurance, provident fund compassionate benefit, and other government benefits from social security schemes. In addition to benefits, this certificate facilitates transferring responsibilities such as filing ITR for the deceased, transfer of patta, and updating telephone/electricity connections. The certificate is also essential for legal heirs of farmers managing land-related queries.

While useful, the legal heir certificate is limited when transferring property, dealing with financial institutions, or in court litigation. In such cases, a succession certificate is necessary.

Legal Heir Certificate vs Succession Certificate

Legal heir certificates and succession certificates serve different purposes. The legal heir certificate recognizes the actual living heirs, issued by the Tehsildar, while the succession certificate, issued by the civil court, identifies the legitimate heirs. In the absence of a nominee or valid will, a legal heir certificate is not final for property transfer. In contrast, a succession certificate determines the rightful heir.
